Applicability:
This User Agreement is a legal binding document between the user and Radium Box. Its subsidiaries/ affiliates (hereinafter referred to as “RD Service”) describing the terms and conditions under which the offered services and products can be used. This user agreement may apply to all products and services sold by RD Service through its official website. Our Support Team, Offices, Sales Executive or agents will govern the use of the services by the individual (‘User’) agrees to follow by this User Agreement.
Both the User and RD Service are jointly referred as the “Parties” and individually as a “Party” to this User Agreement. The Website will have “Terms of Service” specifying certain terms and conditions for using the website or various services/products facilitated by RD Service.
Eligibility to Use:
- The User must have legal authority to enter into a contract with RD Service and use the service of RD Service available on its website.
- By accessing the Website, engaging in any of Sales Channels, or procuring services from RD Service, users of RD Service will consider to have read, understood, and accepted this User Agreement.
- If a User does not agree with any provisions of this Agreement, he/she should refrain from using the services of, or accessing, the Sales Channels of RD Service.
- All rights and obligations with respect to services or products sold, assisted, or otherwise facilitated by RD Service, are governed by the terms of this User Agreement.
Content:
- All Content available through the Sales Channels of RD Service, including without limitation audio, images, software, text, icons, and any materials of a similar nature, is proprietary to RD Service and is also subject to the applicable intellectual property laws. The use by Users of such Content shall be only as provided for in this User Agreement.
- Users shall follow all the directions and instructions that are issued by RD Service concerning the use of Content.
- All service marks, proprietary logos, and trademarks that are displayed on the RD Service website and any/all other Sales Channels belong to RD Service, and no use of these shall be made without express prior written permission.
- RD Service respects the intellectual property and rights of the person (others) . Users has been to report any of instances of over infringement o RD Service website, includes clear identification of copyrighted works, the location the infrinin content, proof of ownership, contact information required.
Website:
The Website is intended for lawful use by genuine Users.
- Users are prohibited from distributing, modifying, selling, or transmitting any content from the Website for commercial purposes without prior authorization.
- The Website may require the User to register to use certain features. During registration, the Users shall provide valid information and shall keep their account credentials confidential.
- RD Service reserves the right to terminate any Website or its service at any time without notice for maintenance or any other reason.
- While RD Service tries to keep a secure Website, Users agree that all downloads of data and information are at their own risk, and RD Service is not responsible for any damage whatsoever to the User’s computer system or loss of data that result from the download of any such data or information.
- RD Service reserves the right to update or change its Website content at any time without notice. Users are also requested to inform about any illegal or unwarranted content so that appropriate action may be taken.
Security and Account Related Information:
Users must maintain the confidentiality of their login details and must inform RD Service if there is any unauthorized access to their account.
RD Service will use all efforts to keep the user’s information confidential as per the applicable laws but does not guarantee protection from hacking. The User Data may also be shared with law enforcement agencies upon their legitimate request.
Using the user details of communication:
- RD Service may use the communication channels provided by the user for transaction-related communication strictly under the compliance of local laws and regulations.
- In the case that Users wish to withdraw the consent for receiving messages or emails, they are to contact RD Service or change the notification settings.
- RD Service is reimbursed against losses arising from erroneous complaints or wrong contact details furnished by the Users.
Force Act:
In extraordinary circumstances, RD Service may not be able to serve the products due to a situation of Force Act. In such cases, Users must reach out to the Service Provider with regard to the resolutions.
RD Service is not liable for any damages whether due to Website or Sales Channel usage.
Advertisements and Linked Websites:
- RD Service has no liability for representations or the content of any third-party websites.
- The User is responsible for checking that the information supplied by advertisers or linked website content is accurate and complete.
- The linked sites are not under the control of RD Service and RD Service is not responsible for their content or changes.
Right of Refusal:
- RD Service reserves the right to refuse its service without reason.
- The User registration may be suspended or terminated if the User violates this User Agreement or if RD Service is unable to verify User information.
- Users shall not carry out prohibited activities or communications including but not limited to, under this Agreement.
Right to Cancel:
Users have to provide accurate information to RD Service, and RD Service India retains the right to cancel products/services in case of unauthorized or incorrect information.
Users shall not hold RD Service liable for cancellations on account of suspected fraud.
Fake Calls and Fraudulent Activities:
RD Service does not ask for sensitive information or fund transfers from Users, and the User should report such requests to RD Service.
Indemnification:
The Users shall indemnify RD Service against losses arising out of break of representation, warranty, or non-performance of contracts.
Users shall solely be liable for break through of any specific rules or regulations.
Miscellaneous:
- If any provision under this User Agreement is held to be invalid or unenforceable, such provision shall be ineffective only to the extent of such invalidity or unenforceability, without affecting in any way the remaining provisions hereof.
- RD Service reserves the right to modify this User Agreement at any time, and it is the responsibility of Users to periodically review changes in the Agreement.
- Confidential information identified by RD Service shall be treated as confidential by Users.
- Users consent to RD Service getting in touch with them for bringing out their feedback and users are free to address their grievances to the Grievance Officer.
- Users are requested to make themselves familiar with the RD Service’s Privacy Policy is updated on its website. The continued use of the Website shall be presumed to be the acceptance of the Privacy policy.
Information We Collect:
We do not collect the private information of the viewers of RD Service. The personal information is also not automatically identified by our servers. We do not use cookies to store your personal information. In case we decide to implement cookies, it shall be for storing visitors’ preferences and record session information to provide a faster, better, more personalized service when you return to our Radiumbox. The same shall be added to the privacy policy. The email addresses of people who communicate with us via the query box and any information volunteered by our viewers may be kept to contact our viewers about questions they may have posed. The information you provide will not be shared with any other commercial business. Neither is such information used for any other purpose other than that mentioned herein. We do not partner with or have special relationships with any ad server companies.
